Mosque – Arbitration and Charity Commission Investigation

Bismillah.  A brief summary of events, with the Arbitration Report appended at the end – the latter is legally binding, and the people who have changed the locks at the mosque and are attempting a total takeover are in violation of this agreement.

10 May 2012: First arbitration meeting.

17 May 2012: Second arbitration meeting, resolving the dispute for the time being and appointing a 6-month interim trust.

11 May 2012: In the meantime, the Charity Commission opened its statutory investigation into extremist and terrorist links around speakers at the mosque, a serious step that is never taken on the basis of an individual complaint, as is clear from the Commission procedures on their website.  They wrote to various people at the mosque about this almost 2 weeks’ later.

The media got hold of the story, and I did a half-hour interview with BBC London (aired 7/6/12) to attempt damage-limitation using conciliatory language about the mosque congregation and trust together dealing with this crisis.  Although the TV & website pieces were quite accurate, the TV piece misrepresented me as being “openly critical of the mosque,” for which they have apologised to me personally.  The  conciliatory language is also clear from my interviews to the Independent and the Evening Standard on 8/6/12, and from the piece on the BBC website.

* The Charity Commission does *not* endorse the list of trustees under any trust on its website, since this is entered by trustees themselves and not checked by the Commission.

In 2011-12, it has become clear that the attempted extremist takeover at the mosque involves supporters and sympathisers of Awlaki, which is no doubt why the Charity Commission investigation has terrified them.  Some people have tried to claim that I am somehow responsible for Awlaki’s visits (I did not organise any of them).  The truth is that whilst I have been outspoken against extremism and terrorism for many years by the grace of God, it is people like Saleh Patel who promoted Awlaki until as late as April 2009 in London (http://www.independent.co.uk/news/education/higher/rosie-waterhouse-universities-must-take-action-on-muslim-extremism-1922730.html ); as did Cage Prisoners (see Hitchens’ report on Awlaki, http://www.socialcohesion.co.uk/files/1289579667_1.pdf ), for whom Saghir Hussain, the lawyer, worked for several years; as did Islam Channel until 2010 (http://www.quilliamfoundation.org/images/stories/islamchannelreport.pdf ), for whom Talat Sultan works.  In contrast, I publicly criticized Awlaki’s extremist views as soon as I learnt about them, e.g. at the City Circle meeting about the Gaza crisis in January 2009.  And about a decade before that, it was my father who forced Abu Qatada out of the mosque by the grace of God.

MUSLIM ARBITRATION SERVICE

ARBITRATION REPORT

The Trustees of Masjid & Madrasa al-Twhid, 80 High Road, Leyton, London E15 2BP, who have been in dispute over the running of the Masjid for a long time, had agreed in writing to submit their dispute to Nizar Boga BSc LL.B(Hons) DMA FRSPH MCIEH JP for arbitration. They have authorised him to be the sole Arbitrator of all issues and conduct the arbitration procedure as he considers fit and proper and make decision which will be final, binding and not subject to appeal in any court of law or tribunal.

Two hearings were held at Crown House, North Circular Road, Park Royal, London NW10 7PN

At the start of the first hearing session on 10 May, Nizar asked all the Trustees to take an oath by holding the Quran in their right hand and swear by Allah to speak the truth and nothing but the truth. All the trustees complied.

THE OUTCOME

RESIGNATIONS

Resignations of the following trustees were offered voluntarily and pronounced without conditions. They will sign resignation documents in due course and the same will be transmitted to the Charity Commission.

INTERIM ADMINISTRATION

Interim Administration for 6 months starting from 17 May 2012 to 17 November 2012 was constructed and announced as follows:

1. Dr Suhaib Hasan – Chairman for the first 3 months and Vice Chairman for the remaining 3 months
2. Mehmud Patel – Vice Chairman for the first 3 months and Chairman for the remaining 3 months
3. Mohamed Patel – Treasurer through out the 6 months
4. Liaqat Ali – Secretary through out the 6 months

The following Trustees were appointed to serve in the Interim Administration for 6 months. All the 10 Trustees may be re elected under the new constitution.

7. Raja Wali Mohammed
8. Muhammad Sethi
9. Talat Sultan

The Trustees, who were appointed during the period of dispute by both sides, will step down permanently but will be eligible for consideration as members of the new charity and administration in future.

It is my sincere desire that all the 10 Trustees will act as one body of Trust to oversee all the functions and responsibilities of managing the affairs of the mosque during this crucial period of six months which will take us pass the Ramadan, Hajj and Olympic period and I request all the mosque users to help and support them in their individual as well as group capacity.

During this period, I would be working closely with the trustees to bring up options for new charity scheme in which I hope to have your input. I hope to consult you regularly in person and through email. Please feel free to talk to me when I visit your mosque, or send me any feedback/comments over the interim period.

Bismillah. Translation of a poster that caught my eye in the Islamic Foundation prayer hall today:

I AM AMAZED …

… at the one afflicted by four [matters],
how he can forget four [verses].

Imam Ja’far al-Sadiq [The Truthful] said:

I am amazed at the one afflicted by fear, how he can forget, “Enough for us is God: what an excellent protector!” [Q 3:173]

I am amazed at the one afflicted by people’s plotting against him, how he can forget, “I entrust my matter to God: truly, God is All-Seeing over His Servants!” [Q 40:44]

I am amazed at the one afflicted by harm, how he can forget, “My Lord! Truly, harm has touched me, whilst You are the Most Merciful of those who show mercy.” [Q 21:83]

I am amazed at the one afflicted by sorrow, how he can forget, “There is no god except You. Glory be to You! Truly, I used to be amongst the wrongdoers.” [Q 21:87]

Al-Tawhid Mosque Dispute Solved!

Bismillah.  As stated yesterday, details to follow after Friday Prayers about the 6-month interim dispute-resolution reached, that will God-willing lay the foundation for a long-term solution.  Part of the agreement was the removal of any ealier website articles relating to the dispute, which is why the previous two posts on this blog have now been deleted.  The mosque website(s) will also be modified at the instruction of the arbiter.  I pray that the congregation of Al-Tawhid Mosque are able to coexist in a peaceful and civilised manner despite our differences, that we should be able to discuss freely.

Interview with a Syrian opposition activist

Bismillah.  Better late than never.  The following is a brief interview conducted on 26th Ramadan 1432 (26th August 2011) with a Syrian journalist & opposition activist, Mohammad Fizou.  The questions and mobile phone number (registered in Turkey) of the interviewee were supplied by a UK-based journalist.  The line was quite poor, hence the brief interview.

1. You coordinate the Syrian Army Defectors’ Facebook page. How many defectors are there in total?

 We have 8,000 people on our Facebook page.  There is much more information on there about our members.

2. Which city do you come from?

I am from Ladhiqiyyah (Latakia).

3. What makes the defectors choose to do so?

They defected from the army (there are over 7,000 of them) because they were ordered to fire with machine-guns at unarmed, civilian protesters.

4. Have ex-soldiers been the only ones shooting at & killing army regulars, or have protestors engaged in violence against the regime at all?

The only people killing soldiers have been the regime’s people.  They killed soldiers who refused to shoot at civilians, and blamed it on the protesters in order to give the world media the impression that the regime had been attacked by the protesters.

5. Do you want a no-fly zone like in Libya, or will you and your men be able to fight against the regime yourselves?

We have about 7,000 men but the regime has many times that number, as is well-known.  Therefore, we need as much support and help as possible.  The Syrian regime’s aircraft have been bombing civilian protesters, so any action that will stop them will be very important.

6. There are different groups of ex-soldiers, such as the Free Officers’ Movement led by Hussain Harmoush and the Free Syrian Army led by Col. Rifal al-Assad.  Is there any plan for them all to come together and form a united army against the regime?

These movements all have the same aim, and therefore they are united in purpose.  They tend to be regional, i.e. composed of defectors from different parts of the country.  The regime tries to make out that we are disunited, but we are not.  We all have the same demands, as the protesters do: stop the killing; stop the massacres; let us have reform.

7. How credible are the Turkish Army’s threats to establish a safety zone inside Syria? Will this affect the revolution, do you think?

Turkey is a friendly country, as are its people and its army.  We would welcome help from any friendly countries, such as Turkey or Britain, since they would not be invading or occupying our country.  But Turkish soldiers have not entered Syria.  The Syrians have fired repeatedly on Turkish troops and have even launched rockets into Turkish territory, but the Turks have not retaliated.  The Turks gave the Syrians a 15-day ultimatum to stop firing on them – this expired yesterday evening (25th August 2011), but the Turks haven’t taken any action in response.

True Story of a Survivor of Terrorism – Sayra Mobeen

Bismillah.

This relates to the twin suicide attacks at the International Islamic University of Islamabad in October 2009.  One of the targets was the women students’ cafeteria.  (Here is BBC and Guardian coverage.)  An injured survivor of that attack has written a brief piece about her experience, over two years later.

I received this from Major (Retd.) Tahir Wadood Malik, who was featured along with IIUI survivors in a moving Channel 4 Dispatches documentary about terrorism in Islamabad: City of Fear.  His comments are given below, followed by Sayra’s story.

Sayra Mobeen is a student at the International Islamic University at Islamabad. she was badly injured in the twin suicide attacks in the university on 20th October 2009.

The extent of trauma can be seen by the fact that it has taken her over two years and lots of persuasion to write her story.

May Allah help us all to overcome this menace of extremism that we are faced with in Pakistan, aamin.

True Story of a Blast Victim

The morning of 20 0ctober 2009 was delightful and astonishing for me not for the country; I was happy to go to classes for my studies and be with my friends. Ignoring the years of unending dilemma of Pakistan facing the threat of terrorism; that every face showed pain did not matter to me.

I am not a keen follower of the news, and that is why I could not feel the pain people faced by being in a bomb blast, or of losing a loved one in a terrorist attack.

The twin blasts in my University that day changed my life, as it was the first strike on women students in Islamabad. This incident left deep effect on my life. Bringing me face to face with a disaster which in its wake brought a lot of challenges for me.

Sadly I am a victim of that incident, and have been lucky to survive to tell my story, and look at life in a different perspective.

I remember that day after classes I came back in my hostel room at about 2:45 pm. My friend Umme Kalsoom came to my room and asked me to accompany her to the cafeteria, so I got up and we left.

We went to the cafeteria fruit shop but they had sold out the fruit etc. I don’t know why we were in hurry that day to go in the café, as we both ignored our class fellows who were sitting outside the café asking us to join them, and entered the main hall of the cafeteria.

We bought salad and some other eatables and sat inside the café on the left side of the hall, we still did not join our friends outside! We realized that we had not bought soft drinks so I went and bought these.

As I reached near the fountain in the hall, on my way back to our table, I suddenly heard a dreadful sound, and saw lots of smoke; my ears were deafened. I felt as if I had been hit by something forcefully. I was disoriented and fell down. The pain made me realize I was hurt and I could feel the pain on my body, arms, legs, forehead and chest. Later I found that the major injuries I received were on my chest.

Humble thanks to Almighty Allah that I was in my senses and tried to walk away from the cafeteria to save myself, but could not. I then saw my friends coming back to look for me; my shirt was full of blood which was coming from the wounds on my head and chest; when Umme Kulsoom  she saw me in this critical condition she started crying.

I asked Umme Kulsoom to look for my cell phone which I lost in this melee so I could call my family, she asked a female employee of café to look after me while she went to look for help.

I was feeling afraid because of the blast not for the pain or my injuries. The café staff told me I had severe injuries so I should go to the hospital, and tried to put me in a taxi, I refused because I did not want to go alone by taxi. The staff then left me and walked away, which hurt me more. I missed my family and friends and started to cry.

In the meanwhile my friends came looking for me, and picked me up, I was in great pain, and they took me to the Pakistan Institute of Medical Sciences. The doctors decided to undertake surgery because of the nature of my injuries. I was very afraid because I knew my family was not with me, and I did not know what would be the result of the operation. But that is perhaps what saved my life.

After initial treatment in the PIMS and in view of the nature of my injuries, I was sent to the Combined Military Hospital at Mangla Cantonment for treatment. I underwent treatment at Mangla and suffered lots of pain and surgical interventions, for approximately four months. During this period my family and I suffered a lot, as they had to arrange for a place to live at Mangla, and commute from Abbottabad to Mangla regularly.

My injuries were similar to the injuries that soldiers receive in the battle field. The doctors at Mangla took great pains to remove the pieces of shrapnel and other stuff in my body, but even then, they could not remove all, and some non-life-threatening pieces of the material that was used in the suicide jacket, are still in my body and will remain in me for my life. It hurts at times, but at least I am alive.

As I said I did not pay attention to news of bomb blasts when I saw it on television or read about this in the newspapers, therefore I could not assess the pain of others; especially those who suffered during terrorist or suicide attacks.

Since my ordeal, I can recognize the pain and difficulties of survivors and victims’ like me, and Alhamdolillah I can empathize with them and help them in their recovery from trauma.

This unpleasant incident did not close the door of life on me; it showed me the other and pleasant direction of life. I am happy, and grateful to Allah that I am passing my life normally, thanks to my family, friends, and many other people who helped me recover, and this has strengthened my belief in the saying that “obstacles come in life to polish one, or make one like a diamond.”

 

Hajj exhibition at the British Museum

Bismillah. This is THE event of London 2012, far more important than a sporting event or a diamond jubilee. It is a unique & historic occasion when the Ka’bah, symbol of the centre of our hearts, has in a sense come to Central London.

The exhibition is brilliant. Go and see it, and take your families & friends (kids go free). A particular connection with the UK is the story of Thomas Cook as Hajj travel agent from 19th-century British India. A “Thomas Cook Hajj travel ticket to Mecca” and pilgrim guidebook are on display. Perhaps Thomas Cook should look into this again: the barakah (blessings) may save their ailing business.

Also worth seeing is the “Church of the Holy Sepulchre” temporary exhibit (on the right as you enter the museum). This includes a brief history of Jerusalem and some details about the Ottoman edict that split the church building amongst six different churches (sects).

Israel/Palestine at the CoE General Synod

Bismillah.

Earlier this month, Rabbi Jonathan Wittenberg and I addressed a fringe meeting on Israel/Palestine at the CoE General Synod, Church House, London.

We spoke in our capacities as Patrons of the Parents’ Circle, Friends of the Bereaved Families’ Forum (Ali Abu Awwad, Robi Damelin, etc.). The Bishop of Truro chaired & the Archbishop of Canterbury made time to attend our session. We discussed peace-building and improving Muslim-Jewish relations in the UK & abroad.

I noticed a dome above the Church House reception, with an inscription from scripture in English around the inside border of the dome, which reminded me of the dome above Mount Safa at the Grand Mosque in Mecca. The inscription began, “The beginning of wisdom is the fear of the Lord …” This reminded me of the Islamic saying, “Ra’s al-hikmah makhafatullah (The height of wisdom is the fear of God).” The latter is often attributed to the Prophet Muhammad, peace be upon him, but may actually be a teaching of his cousin and son-in-law, Caliph Ali.

The Gospel of Barnabas & the Daily Mail

Bismillah. A comment about yesterday’s Daily Mail story (http://www.dailymail.co.uk/news/article-2105714/Secret-14million-Bible-Jesus-predicts-coming-Prophet-Muhammad-unearthed-Turkey.html#ixzz1nLnLDMzu):

The so-called Gospel of Barnabas contradicts the Qur’an, which affirms that Jesus was the Messiah, not the Prophet Muhammad, peace be upon him. It also contains the story of Adam’s prayer invoking the name of Muhammad, which is found in a disputed hadith, probably spurious (mawdu’). The “Gospel of Barnabas” would thus appear to be a Muslim fabrication.
